Breathe Inc. (“Breathe,” “Company,” “we,” “us,” or “our”) respects the privacy of our users. This Privacy Policy (“Policy”) describes how we collect, use, disclose, and safeguard information in connection with the website located at https://breatheb12.com/ (the “Site”). By visiting the Site or using its features, you agree to the terms of this Policy and to our Terms of Service

We may combine any of the above with information we obtain from other sources (e.g., social media, data brokers) and will treat that combined data as personal information.

  • Web Beacons / Pixels. Embedded in emails and pages to measure engagement.

  • Log Files. Server logs capture IP address, browser type, and other technical data.

3. How We Use Information

We use personal and other information to:

  • Provide, maintain, and improve the Site and our products.

  • Fulfill your orders and other requests.

  • Process payments via our PCI‑DSS Level 1 certified payment processor (we do not store full card numbers).

  • Send transactional communications (e.g., shipping confirmations).

  • Send marketing communications—email, SMS (with express written consent), push notifications—You may opt out at any time, see Section 6.

  • Conduct analytics, research, and interest‑based advertising (see Section 5).

  • Detect, investigate, and prevent fraud or security incidents.

  • Comply with legal obligations and enforce our Terms.

4. How We Share Information

We disclose information only as described here:

  1. Affiliates. Shared for purposes consistent with this Policy.

  2. Service Providers. Hosting, payment processing, order fulfillment, analytics, email/SMS platforms, customer‑relationship management.

  3. Advertising & Analytics Partners. See Section 5 for opt‑outs.

  4. Social Media & Plug‑ins. When you interact with “Like” buttons or sign‑in integrations, data flows to the platform under its own privacy policy.

  5. Legal & Business Transfers. Compliance with law, protection of rights, or during corporate transactions.

  6. Aggregated or De‑identified Data. That cannot reasonably identify you.

We do not knowingly “sell” or “share” personal information for monetary consideration, but some states consider targeted advertising a “share.”  See Section 6.3 for opt‑out options. 

5. Cookies, Analytics & Interest‑Based Advertising

  • We use first‑ and third‑party cookies, pixels, and similar tools for Site functionality, analytics (e.g., Google Analytics), and advertising (Facebook Custom Audiences, Google Ads, etc.).

  • Third‑party cookies may set cross‑device identifiers to serve ads and limit frequency.

Opt‑Outs

  • Browser: use links at optout.networkadvertising.org, optout.aboutads.info, or your browser settings.

  • Mobile Apps: download AppChoices or adjust Ad ID settings (iOS “Limit Ad Tracking”, Android “Opt out of interest‑based ads”).

  • Google Analytics: install the GA Opt‑out Browser Add‑on.

  • We honor Global Privacy Control (GPC) signals where reasonably feasible.

Our Site currently does not respond to “Do Not Track” headers.

6. Your Choices & Privacy Rights

6.1 Marketing Communications

Click “unsubscribe” in emails, reply “STOP” to SMS, or email support@breatheb12.com.

6.2 Account Information

Log in to your account or email us to access or correct certain information.

6.3 U.S. State Privacy Rights

Residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Florida, Montana, Tennessee, and Indiana have the right to:

  • Access/Know the categories and specific pieces of PI we hold.

  • Delete PI (subject to legal exceptions).

  • Correct inaccurate PI.

  • Opt Out of “selling,” “sharing,” or targeted advertising.

  • Limit the use of Sensitive PI (CPRA).

To exercise these rights:

  1. Email support@breatheb12.com with “Privacy Request” in the subject.

  2. Or visit Do Not Sell or Share My Personal Information in the footer.
    We will verify your identity before responding and will not discriminate against you for exercising rights.

6.4 California “Shine the Light”

California customers may request a list of third parties that received their direct‑marketing information in the prior calendar year. Email support@breatheb12.com.

6.5 International Users

Geographic Scope Disclaimer. The Site is controlled and operated from the United States and is intended for U.S. customers only. We do not market or ship products to individuals located outside the United States, nor do we intentionally monitor the online behavior of such individuals. If you reside outside the United States and choose to provide personal information, you acknowledge that your information will be processed in the United States pursuant to this Policy. 

7. Security

We employ industry‑standard physical, administrative, and technical safeguards (e.g., HTTPS/TLS encryption, tokenized payments, access controls). No method is 100 % secure; we cannot guarantee absolute security.

8. Data Retention

We keep information only as long as needed for the purposes stated above, including:

  • Orders & tax records: 7 years.

  • Marketing lists: until you opt out or 2 years of inactivity.

  • Analytics cookies: 26 months.
    When data is no longer required, we delete or de‑identify it. Backup archives are overwritten on a rolling 35‑day cycle.

9. International Data Transfers

We are based in the United States. By using the Site, you consent to the transfer, storage, and processing of your information in the U.S. and other countries that may not provide equivalent privacy protections. Where applicable, transfers are governed by Standard Contractual Clauses or the EU‑U.S. Data Privacy Framework.

10. Children’s Privacy

The Site is intended for users 18 and older, and we do not knowingly collect personal information from anyone under 13. If we learn that we have inadvertently collected such data, we will delete it promptly.

11. Links to Other Websites

Our Site may contain links to third‑party sites. We are not responsible for their content or privacy practices. Review the privacy policies of any third‑party site you visit.

12. Changes to This Policy

We may update this Policy periodically. If we make material changes, we will post the revised Policy and update the “Last Updated” date. Your continued use after the Updated Date signifies acceptance.
